Amendment No. One to the Plan Document of the Porac Legal Defense Fund

(As amended through December 29, 2014)

Pursuant to Article XI of the Trust Agreement and Article VII of the Plan Document, the Board of Trustees amends the Plan Document as follows: 

1. Section 12 (Benefit Plan V, Retiree Coverage) of Article III (Benefits) is amended as follows: a) subsection (a) is deleted, b) current subsections (b)-(g) are relettered as subsections (a)-(f), c) the reference in current subsection (b)(3) to (d)(1)-(5) is changed to (c)(1)-(5), d) the phrase “subsections (a) and (b)” in current subsection (c) is changed to “subsection (a),” e) the reference in current subsection (d)(6) to subsection (e) is changed to subsection (d), f) deleted from current subsection (g) is the phrase “with respect to coverage under section 12(a) (but not with respect to coverage under section 12[b])” and g) subsections (g) and (h) are deleted.
2. The following is added as a) subsection (d) to Section 1 (Benefit Plan I, Civil, Criminal and Administrative Actions) of Article III (Benefits), b) subsection (c) of Section 2 (Benefit Plan II, Civil and Criminal Actions) of Article III (Benefits) and c) subsection (d) of Section 3 (Benefit Plan III, Civil, Criminal and Limited Administrative Actions) of Article III (Benefits): “Legal representation by a Panel Attorney or Panel Field Representative in the administrative appeal of a denial of a permit to carry concealed firearms by the agency from which the Participant retired for either service or disability, provided that (i) the Participant is a RAM member, (ii) there is an administrative appeal procedure in place, (iii) the Participant retired in good standing and is receiving monthly retirement benefits and (iv) the Participant submits a claim for coverage within twelve (12) months of the effective date of retirement.”
3. This amendment is effective on June 26, 2015.
   This amendment was adopted by the Board of Trustees at a regular meeting held on June 5, 2015, in Sacramento, California.
